1. Agreement to Terms
By creating an account or using RokWise ("the Service"), you agree to these Terms of Service. If you're using RokWise on behalf of a business, you confirm you have the authority to bind that business to these terms.
2. The Service
RokWise is a cloud-based point-of-sale and business management platform covering sales, inventory, purchasing, customer and supplier management, finance, and related functions, accessible at app.rokwise.co.ke.
3. Accounts
You must provide accurate information when registering and keep your login credentials secure. You're responsible for all activity that occurs under your account and any staff accounts you create.
4. Free Trial
New accounts receive a 14-day free trial with no credit card required. At the end of the trial, you may choose a paid plan to continue using the Service. If you don't upgrade, your account is paused, not deleted, so your data is preserved and you may resume at any time by subscribing.
5. Subscription Plans & Billing
RokWise offers Starter, Business, and Enterprise plans at the pricing published at rokwise.co.ke. Subscriptions are billed monthly and paid via M-Pesa. We may change our pricing from time to time; we'll give you reasonable notice before any change takes effect for your account. Fees are non-refundable except where required by law.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to access another business's data or bypass the Service's security
- Reverse-engineer, resell, or sublicense the Service without our written permission
- Introduce malware or interfere with the Service's normal operation
We may suspend or terminate accounts that violate these terms.
7. Your Data, Your Business
All business data you enter into RokWise — your sales, inventory, customer records, financial data, and so on — belongs to you. We don't claim ownership of it and won't use it for any purpose other than providing the Service to you, as described in our Privacy Policy. You're responsible for the accuracy of the data you enter and for complying with any laws that apply to your business, including tax and record-keeping obligations.
8. Service Availability
We aim for high availability, and RokWise's Point of Sale includes offline functionality so you can keep selling during connectivity interruptions. However, we don't guarantee uninterrupted or error-free operation of the Service, and we're not liable for losses arising from downtime, maintenance, or factors outside our reasonable control.
9. Intellectual Property
RokWise and its underlying software, design, and branding are owned by us and protected by applicable intellectual property laws. These Terms don't grant you any rights to our intellectual property beyond your right to use the Service as intended.
10. Limitation of Liability
To the fullest extent permitted by law, RokWise is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including business decisions made using data or reports generated by RokWise. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months preceding the claim.
11. Termination
You may cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or fail to pay applicable fees. Upon termination, your right to use the Service ends; your data will be handled as described in our Privacy Policy.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of Kenya. Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of Kenya.
